начинается отопительный сезон. кто-то, возможно, захочет поставить себе газовый котел. в предыдущих статьях мы выяснили, что теперь у нас можно выбирать поставщика. правда, при его смене надо переоформлять субсидию. несмотря на якобы конкурентный рынок, цены необоснованно растут. а “нефтегаз” жалуется на 11 млрд. убытка. теперь постараемся понять еще один важный момент: кто отвечает за газовые трубы в многоквартирных домах? их ремонт и эксплуатацию? а главное, сколько это теперь стоит?
we have already said that the new model of the gas market provides for the separation of the functions of selling gas and supplying it to consumers. traders trade, and suppliers, former regional gas companies, renamed into operators of gas distribution systems (in the ukrainian abbreviation - grm), are engaged in servicing the intra-house gas networks.
if earlier we simply received a receipt and paid, say, to "kievgaz", they called there or at 104, smelling gas, or when it was necessary to connect some device officially, now the trader is virtual. figuratively speaking, it may be a nearby bakery, which has acquired the appropriate license. she is not obliged, is not authorized and does not know how to repair gas pipes in apartments and maintain house meters. not to mention gas pipelines.
it is well known that our gas pipelines are in disrepair and require investment. suffice it to recall the depressurization of the main gas pipeline "kiev-west of ukraine" on september 15 in the shepherds of the kiev region. then there were no casualties and destruction, but it was just lucky. so to speak, a "probe" of serious problems that may be. nevertheless, according to eyewitnesses, gas from the gas pipeline burst out of the ground with tremendous force: there was a "wild noise" in the sky, reminiscent of the roar of aircraft turbines.
main gas pipelines should be serviced by the enterprises of the "oil and gas" system. but, talking about losses and worsening performance, “neftegaz” said that “we have reduced our capital investments by 50%”. “this was an important and timely response to the decline in the attractiveness of investment projects in the industry,” said the head of the company andrey kobolev.
considering that, according to the ministry of finance's forecast, the losses of “oil and gas” in 2020-2023 may amount to almost uah 22 billion, capital investments will continue to decline. by the way, uah 22 billion. - this is according to the baseline scenario. there are also other scenarios: stressful and optimistic. according to the optimistic scenario, losses will amount to only uah 10.05 billion, under the stress scenario - uah 23.32 billion. in any case, no one promises profit.
okay, the oil and gas main gas pipelines will still have some maintenance. he has nowhere to go. but what about the house gas networks, which are aging from year to year and become simply dangerous for the people who live in these houses?
this is remembered only when there is a gas leak in high-rise buildings (often when using gas boilers), an explosion, collapse of walls, death of people. since the beginning of the year, more than 100 explosions have occurred in ukraine as a result of the deterioration of gas networks. killed 200 people and injured another 700. the last high-profile case - this summer in kiev on poznyaki, when half of the house was demolished and several people died.
then who is responsible for the pipes inside the house? on this score we now have a big legal confusion. according to the law on housing and communal services, the system is serviced by the timing operator. however, the law, spelled out in the interests of the communal mafia, does not specify what is included in the cost of maintenance. if an accident occurs, it may turn out that repair work is carried out under separate contracts, a special tariff and are not included in the monthly fee.
in general, as we have written more than once, the new law "on housing and communal services" is a law on irresponsibility and dictate of communal companies. they are given the benefit of the doubt. if earlier a pipe burst inside the house, an exploded gas or other infrastructure problems were the concern of emergency workers, now they are transferred to the apartment owners or the management of the osmd.
on the other hand, according to the gas distribution system code, the owner should be involved in the equipment and be responsible for its condition. or the one who has gas networks on the balance sheet. if there is no legal confirmation of ownership of the timing operator's gas networks, they must be transferred to him for use. not transferred, which means that he does not serve them.
therefore, osmd, housing administrations, house managers and others do not understand: are they obliged to sign contracts with the former regional gas companies for the maintenance of in-house gas networks, or can they find a replacement and pay only for the maintenance of gas networks to the “entrance” meter?
for example, some osmd will not want to sign an agreement with the former regional gas company for the operation of in-house networks. will decide that it is cheaper to hire a pensioner, uncle vasya, who has worked in the gas industry all his life. he will come once a quarter, feel the pipes, check the “clamps” - the quality is higher, the price is lower. is it possible? some lawyers say that it is possible, others that it is impossible. some residents' associations tried to look for the truth in the courts - each time a new interpretation of the law on housing and communal services.
now the verkhovna rada is waiting for a second second reading of bill no. 2458, according to which houses that have not entered into an agreement for the maintenance of intra-house networks with a specific timing operator will be obliged to do this forcibly on the basis of a standard contract, and pay for the service separately. who will coerce? apparently the local authorities. since the law has not been adopted and there is a lot of lobbying fuss around it, there may be different options on the way out. but in any case, everything is done so that uncle does not shine in a row.
now about how much will have to pay for the maintenance of gas pipes formally in order and for the phantom "insurance" against explosions. given the constant whining of the ministry of energy that the current tariffs for gas transportation are extremely low, and timing operators have no money, you can be sure: no one will be able to carry out the function of maintaining intra-house networks for free.
according to some sources, the ministry of energy made miscalculations for how much the former regional gas companies would again take on the unbearable burden of maintaining the networks, and came to the conclusion that the tariffs should be about 50% higher than the current ones. this will increase the number on your utility bill by a total of 5-10%.
but it all depends on the nuances. will there be an upper bar for the cost of such services? if not, what is nkreku going to include in the tariff? what to do with persistent defaulters: will some of them be scattered over all tenants, or is it planned to carry out individual work? a lot of questions. no answers yet. one thing is obvious - we will have another type of utility payments. and perhaps not the last.
